Can the ZTA be saved?

Montgomery County residents have put forward a protective ZTA and call on the Council to amend the current ill founded ZTA with the proposed amendments. So far, they have not acted to propose these amendments.   

This is what the Montgomery County RESIDENT ADVOCATES’ Amendments do:
1. Delay the effective date of the ZTA by 90 days to allow time to fix some of the procedural lapses and implement new regulations.
2. Restore the protective 60-foot dwelling setbacks.
3. Remove impediments to Hearing Examiner’s fair evaluation of facts and evidence in “conditional use” reviews, striking ZTA language that pre-ordains outcome of hearings in favor of wireless applicants
4. Create a tiered hierarchy for replacement poles that promotes equity for all neighborhoods regardless of above-ground or below-ground electric utilities.
5. Require equipment to be vaulted when practicable, and set strict above ground limits on equipment size and noise levels.
6. Allow only smaller sized antennas on roof-tops of lower, 35-foot buildings. Retain 50-foot building height for larger antennas and equipment.
7. Enhance and mandate concealments and design standards for antennas and equipment, and remove “opt-out” standards. 


Unless ALL of these amendments are made- KILL THE BILL. Nothing can save it .
